Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using our audio streaming application (“App”), you agree to be bound by these Terms of Service (“Terms”) between you and StreamDev Technologies OÜ (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the App and delete it immediately.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction if higher) to use this App. By using the App, you represent and warrant that you meet this age requirement.

We reserve the right to modify these Terms at any time at our sole discretion. Your continued use of the App following any updates to these Terms constitutes your acceptance of such changes. We will notify you of material changes through the App. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the App.

2. Service Description

2.1 What We Provide

The App enables you to stream microphone audio from your mobile device to a PC on your local network. This service is provided “as is” and “as available.”

2.2 Service Limitations

• The App requires a stable local network connection to function properly
• Audio quality and performance depend entirely on your network conditions and device capabilities
• We do not guarantee any level of service, uptime, or functionality
• We may modify, suspend, or discontinue any aspect of the service at any time without notice
• The service is limited to personal, non-commercial use
• We reserve the right to impose usage limits at our sole discretion

3. Subscription Terms & Billing

3.1 Subscription Options

We offer the following purchase options:

• Monthly subscription (auto-renewing)
• Yearly subscription (auto-renewing)
• Lifetime purchase (one-time payment)

3.2 Billing and Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your subscription will be renewed according to your app store’s standard billing practices (typically within 24 hours before expiration)
• We may change subscription prices at any time at our sole discretion
• Price changes will apply to your next subscription period after notice
• By subscribing, you authorize recurring charges to your payment method

3.3 Cancellation Policy

• You may cancel your subscription at any time through your app store account settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to premium features until the end of your paid period
• We do not provide prorated refunds for partial subscription periods

3.4 Refund Policy

All purchases are processed through the respective app stores. Refunds are subject to the app store’s refund policy where you made your purchase. We do not have access to process refunds directly as we do not maintain user accounts or payment information.

3.5 Payment Processing

All payments are processed by the respective app stores (Apple App Store or Google Play Store) and managed through RevenueCat. We do not directly handle or store any payment information.

4. User Responsibilities

4.1 Prohibited Activities

You expressly agree NOT to engage in ANY of the following activities:

• Reverse engineer, decompile, disassemble, decode, decrypt, or otherwise attempt to derive or discover the source code, underlying algorithms, or structure of the App, Windows client software, Windows audio driver, or any component thereof
• Analyze, study, examine, test, or inspect the App, Windows client, Windows audio driver, or any related software through any means whatsoever
• Use any debugger, emulator, simulator, monitoring tool, network analyzer, packet sniffer, or similar tools on any of our software
• Modify, port, adapt, translate, create derivative works, or prepare any work based on our software
• Remove, alter, circumvent, avoid, bypass, disable, damage, or interfere with any security features, licensing mechanisms, or functionality
• Use any automated means including but not limited to robots, spiders, scrapers, or any other method to access, interact with, or collect data from our software
• Attempt to probe, scan, penetrate, or test the vulnerability of our systems or breach any security or authentication measures
• Monitor or copy any material, code, or functionality for any purpose
• Interfere with, disrupt, or attempt to gain unauthorized access to any portion of our software, systems, or services
• Use our software to develop, support, or assist in the development of competing products or services
• Disclose, publish, or disseminate any information obtained through prohibited analysis of our software

4.2 Audio Recording Compliance

You are solely and entirely responsible for:

• Complying with ALL applicable international, federal, state, and local laws regarding audio recording
• Obtaining all necessary written consent before recording any conversations or audio
• Ensuring your use of the App complies with all privacy laws, wiretapping laws, and surveillance regulations
• Any legal consequences arising from your recording activities

WE EXPRESSLY DISCLAIM ANY RESPONSIBILITY FOR YOUR RECORDING ACTIVITIES. You acknowledge that illegal recording may result in severe civil and criminal penalties, and you agree to hold us harmless from any consequences of your use.

4.3 Network Security

You acknowledge and agree that:

• You are responsible for the security of your local network
• We are not liable for any security breaches on your network
• You should use secure, password-protected networks when streaming sensitive audio

5. Intellectual Property

5.1 Ownership

The App, including all content, features, and functionality, is owned by us and is protected by international copyright, trademark, and other intellectual property laws.

5.2 License Grant

Subject to your strict compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App solely for your personal, non-commercial use on devices you own or control. This license may be revoked at any time at our sole discretion. No other rights are granted, and all rights not expressly granted are reserved by us.

5.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Sell, rent, lease, or sublicense the App
• Use the App for any commercial purpose without our written consent

6. Limitations of Liability

6.1 Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE DISCLAIM ALL WARRANTIES. YOU USE THE APP AT YOUR SOLE RISK.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

6.3 Service Availability

We expressly disclaim any obligation to maintain the App or provide any level of service. We do not guarantee:

• The App will function or be available at any particular time
• Any particular level of audio quality or performance
• Compatibility with any devices or network configurations
• That errors or defects will be corrected
• That the App is free of harmful components

7. Termination

7.1 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:

• Breach or suspected breach of any provision of these Terms
• Our request by law enforcement or other government agencies
• Discontinuation or material modification of the App
• Technical or security issues
• Non-payment of any applicable fees
• At our sole discretion for any reason or no reason

We have no obligation to provide refunds upon termination.

7.2 Effect on Subscriptions

Upon termination:

• Active subscriptions will continue until the end of the current paid period
• No refunds will be provided for unused subscription time
• Lifetime purchases will be forfeited if termination is due to Terms violation

7.3 Termination by You

You may stop using the App at any time. To cancel subscriptions, use your app store account settings.

8. Governing Law and Disputes

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia and the European Union, without regard to conflict of law provisions.

8.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Harju County, Estonia.

8.3 Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. If we cannot resolve the dispute informally, you agree that any dispute will be resolved through binding arbitration in accordance with the Rules of the Estonian Chamber of Commerce and Industry.

9. General Provisions

9.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

9.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

9.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

9.4 Assignment

You may not assign or transfer these Terms or any rights granted hereunder. We may assign these Terms without restriction.

9.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

9.6 Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys’ fees) arising from your use of the App or violation of these Terms.
